Several Springdale officials testified in support of the transfer, saying the city, and particularly that area, would benefit from economic development.
Austin told the board his liquor store would be in a separate building from the gasoline station. Former Republican state Sen. Jim Holt and Bill Phillips of the Arkansas Beverage Retailers Association testified against the transfer request, saying that in the past state law has been interpreted as prohibiting package stores at businesses that primarily sell other products such food or gasoline.
Board Chairman Mickey Powell noted that in April the state Supreme Court upheld the board's decision to allow Sam's Club in Fayetteville to operate a package store in the same building with its main store, with a wall separating the two stores.
"The Supreme Court of the state of Arkansas has redrawn the lines of the field," Powell said.
